Supply Chain Visibility: Export Controls are not BAU

When a company like Bosch incurs a US$36 million penalty, it’s a reminder that export controls are not BAU.

According to the U.S. Bureau of Industry and Security, Bosch’s non-US operations exported products incorporating U.S.-origin technology to Huawei and its affiliates between 2020 and 2024 without the required licences, triggering the Foreign Direct Product Rule.Tradekins participated in two sessions at the recent UNODC Regional Public–Private Partnership Dialogue in Singapore jointly organised by the UK Government; and one conclusion stood out above all others: technology is no longer the principal constraint.

While the facts of the case are specific, the underlying challenge is one that many organisations face. Export controls today are increasingly driven not by where a product is manufactured, but by the technology, software, intellectual property, and end-users connected to it.

This creates a more complex operating environment. Products designed, manufactured, and sold entirely outside the US may still be subject to U.S. export controls. Commercial decisions that appear routine can carry significant regulatory consequences if organisations do not fully understand the technology lineage and regulatory nexus embedded within their supply chains.

The lesson from this case is not simply about compliance. It is about governance and visibility.

Boards and senior management teams should be asking whether they have sufficient visibility over technology dependencies, customer relationships, distribution channels, and third-party partners. Equally important is whether export control considerations are being incorporated early enough into business, procurement, and product development decisions.
